OverTier Operations and NFL International Licensing, Inc. (together “We”, “Our” or “Us”) are committed to protecting and respecting your privacy.
INTRODUCTION
This policy (together with any end-user licence agreement (“EULA”), Our subscription products terms (https://nflwebtv.com/terms-and-condition/) (“General Terms”) and any additional terms of use incorporated by reference into the EULA or the General Terms, together “Our Terms of Use”) applies to your use of:
1 Any of the subscription products for viewing NFL content that We offer (“Services”) either through Our site (https://nflwebtv.com/) (“Services Site”) or the Apps (as defined below).
2 Any of Our application software programs for accessing the Services (“App”) available on any site (“App Site”), once you have downloaded a copy of the App onto your device (e.g. mobile telephone, handheld device, computer, laptop, smart TV, etc) (“Device”).
unless the EULA states that a separate privacy policy applies to a particular Service, in which case that privacy policy only applies.
This policy sets out the basis on which any personal data We collect from or about you, or that you provide to Us, will be processed by Us. Please read the following carefully to understand Our views and practices regarding your personal data and how We will treat it.
For the purposes of applicable data protection laws including, without limitation, the General Data Protection Regulation ((EU) 2016/679), NFL International Licensing, Inc. (a Delaware corporation with company registration number 7117152 and registered office at 345 Park Avenue New York NY 10154) is the sole data controller of any personal data We collect from you, or that you provide to Us, save regarding certain financial data (i.e. payment card number, expiration date, and any other payment card details necessary to process a payment for a subscription to Game), in relation to which NFL International Licensing, Inc and OverTier Operations (a Cayman Islands exempted company with company registration number 319669 and registered office at P.O Box 2510, Kensington House, 69 Dr. Roy’s Drive, George Town, Grand Cayman KY1-1104 Cayman Islands) are each data controllers for the purposes of applicable data protection laws.
Our Sites, the App and the Services may, from time to time, contain links to and from the websites of Our partner networks, advertisers and affiliates (including, but not limited to, websites on which the App or the Services, the App, or Our Sites are advertised, NFLShop.com, and the websites of the Member Clubs). If you follow a link to any of these websites, please note that: (i) these websites are not operated by Us; (ii) any services that may be accessible through them have their own privacy policies; and (iii) We do not accept any responsibility or liability for these policies or for any personal data that may be collected through these websites or services, such as contact and location data. Please check these policies before you submit any personal data to these websites or use these services.
INFORMATION WE COLLECT FROM YOU
1 We will collect and process the following data about you:
Information you give Us (Submitted information): This is information you give Us about you by filling in forms on the App Site and the Services Site (together “Our Sites”), or by corresponding with Us (for example, by e-mail or chat). It includes information you provide when you register to use the App Site, download or register an App, subscribe to any of Our Services, search for an App or Service, make an in-App purchase, share data via an App’s social media functions, enter a competition, promotion or survey, submit comments or content, use a send-to-a-friend feature, or directly contact Us with questions or feedback and when you report a problem with an App, Our Services, or any of Our Sites. If you contact Us, We will keep a record of that correspondence in accordance with the data retention section below.
The information you give Us may include
your name, address, e-mail address, postal address and phone number, personal description and photograph;
unique identifiers such as a username or password and other registration information; demographic information, such as age and gender;
financial information, as mentioned above;
the Device’s phone number;
Communications preferences; Search queries;
Comments and other information posted in Our interactive online forums; Correspondence and other information that you send to Us;
Additional information as otherwise described to you at the point of collection or pursuant to your consent; and
Information We collect about you and your Device. Each time you visit one of Our Sites or use one of Our Apps, We may automatically collect the following information:
technical information, including the type of Device you use, a unique Device identifier (for example, your Device’s IMEI number, the MAC address of the Device’s wireless network interface), mobile network information, your Device operating system, the type of browser you use, time zone setting, your Internet Protocol (IP) address, which is the number automatically assigned to your computer whenever you access the Internet and that can sometimes be used to derive your general geographic area, your device type or mobile carrier, Our browser type and operating system, (Device Information);
details of your use of any of Our Apps or your visits to any of Our Sites including, but not limited to traffic data, information collected through cookies, web beacons, local shared objects (e.g. Flash cookies), and other technologies, information about your interactions with e-mail messages, such as the links clicked on and whether the messages were received, opened, or forwarded, and standard server log information, whether this is required for Our own billing purposes or otherwise and the resources that you access (Log Information).
Location information. We also use geolocation technology to determine your current location. Some of Our location-enabled Services require your personal data for the Services to work. If you wish to use the particular Services, you will be asked to consent to your data being used for this purpose.
Information We receive from other sources (Third Party Information). We are working closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies).
Unique application numbers: when you install or uninstall an App or a Service containing a unique application number or when such an App or a Service searches for automatic updates, that number and information about your installation, for example, the type of operating system, may be sent to Us.
Where We need to collect personal data by law, or under the terms of a contract We have with you and you fail to provide that data when requested, We may not be able to perform the contract We have or are trying to enter into with you (for example, to provide you with the Services). In this case, We may have to cancel a product or service you have with Us but We will notify you if this is the case at the time.
DATA SECURITY
As is set out below, We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, We limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on Our instructions and they are subject to a duty of confidentiality.
We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where We are legally required to do so.
All information you provide to Us which We hold is stored on Our secure servers. When you provide any sensitive information (such as a credit card number) and geo- location to Us or Our chosen third-party provider of payment processing services, We encrypt the transmission of that information using secure socket layer technology (SSL). Where We have given you (or where you have chosen) a password that enables you to access certain parts of the App, the Services or Our Sites, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.
Unfortunately, the transmission of information via the internet is not completely secure. Although We will do Our best to protect your personal data, We cannot guarantee the security of your data transmitted to the App, the Services or Our Sites; any transmission is at your own risk.
CHANGES TO PRIVACY POLICY
We reserve the right to change this policy from time to time as We consider appropriate in response to legal or business developments. Any changes We may make to Our privacy policy in the future will be posted on this page and, in the case of material changes, notified to you by e-mail (using the email address specified in your account) or when you next start the App or log onto the Services Site. The new terms may be displayed on- screen and you may be required to read and accept them to continue your use of the App or the Services.
